Legal Agreement

These Terms and Conditions constitute a legally binding agreement between you and Oikos Care. By accessing our website, engaging our services, or entering into a service agreement with us, you acknowledge that you have read, understood, and agree to be bound by these terms.

These terms supplement and should be read in conjunction with our Terms of Service and Privacy Policy. If you do not agree with any part of these terms, you must not use our services or website.

User Obligations and Responsibilities

1. Legal Capacity and Compliance

By engaging our services, you represent and warrant that:

  • You are at least 18 years of age and have the legal capacity to enter into binding contracts under the laws of Cyprus
  • You have the authority to engage cleaning services for the property in question, either as the owner, authorized tenant, or designated representative
  • All information you provide to us is accurate, current, and complete
  • You will comply with all applicable laws, regulations, and these terms when using our services

2. Property Access and Safety

You agree to:

  • Provide safe and unobstructed access to all areas requiring cleaning services
  • Disclose any hazardous conditions, materials, or special circumstances present at the property
  • Ensure pets are secured and do not pose a risk to our team members
  • Provide working utilities necessary for cleaning services, including water and electricity
  • Remove or secure valuable, fragile, or irreplaceable items before scheduled services
  • Inform us of alarm systems, access codes, or special entry procedures

3. Communication and Cooperation

You are responsible for:

  • Maintaining current and accurate contact information with us
  • Responding to communications from us in a timely manner
  • Providing clear instructions regarding service expectations and preferences
  • Notifying us promptly of any concerns or issues with service quality
  • Giving appropriate notice for schedule changes or service cancellations

4. Payment Obligations

You agree to:

  • Pay all fees and charges according to the agreed payment terms
  • Provide valid payment information and ensure sufficient funds are available
  • Pay applicable late fees if payments are not received by the due date
  • Cover any additional costs arising from special requests or circumstances not covered in the original agreement
  • Reimburse us for any bank charges, transaction fees, or collection costs associated with payment processing or recovery

5. Conduct and Behavior

You agree to treat our team members with respect and dignity. You must not:

  • Engage in any form of harassment, discrimination, or abusive behavior
  • Make inappropriate comments or advances toward our staff
  • Create an unsafe or hostile work environment
  • Interfere with our team members' ability to perform their duties
  • Engage in any illegal activities at the property during service provision

We reserve the right to immediately terminate services if any team member feels unsafe or is subjected to inappropriate conduct.

Liability and Warranties

6. Service Warranties and Limitations

While we strive to provide high-quality cleaning services, we make no express or implied warranties regarding:

  • The removal of all stains, marks, or damage that existed before our service
  • Results on surfaces that are damaged, worn, or improperly maintained
  • Outcomes dependent on factors beyond our control, such as material quality or previous damage
  • Specific timeframes for service completion beyond reasonable estimates

7. Disclaimer of Consequential Damages

To the fullest extent permitted by Cyprus law, Oikos Care shall not be liable for:

  • Indirect, incidental, special, or consequential damages of any kind
  • Loss of profits, revenue, data, or business opportunities
  • Emotional distress or reputational harm
  • Damages resulting from property conditions not disclosed to us
  • Issues arising from pre-existing damage or wear to surfaces

8. Limitation of Total Liability

Our total aggregate liability for any and all claims arising from our services, whether based on contract, negligence, or any other legal theory, is limited to the amount you paid for the specific service that gave rise to the claim.

This limitation applies regardless of whether we have been advised of the possibility of such damages and even if a limited remedy fails of its essential purpose.

9. Property Damage Claims

If you believe damage occurred during our service:

  • You must notify us in writing within 48 hours of the service completion
  • Provide photographic evidence and detailed description of the alleged damage
  • Allow us reasonable opportunity to inspect the damage and attempt resolution
  • Cooperate with any investigation or assessment process

Claims not reported within 48 hours may not be considered. We are not liable for damage to items that were not properly secured or for pre-existing conditions.

10. Indemnification

You agree to indemnify, defend, and hold harmless Oikos Care, its owners, employees, and representatives from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these terms, your violation of any law or rights of third parties, or your misuse of our services.

Legal Information and Dispute Resolution

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these terms.

12. Jurisdiction and Venue

Any legal action or proceeding arising out of or relating to these terms or our services shall be brought exclusively in the courts of Cyprus, and you hereby consent to the personal jurisdiction and venue of such courts. You waive any objection to jurisdiction or venue in such courts.

13. Dispute Resolution Process

Before initiating formal legal proceedings, we encourage you to:

  • Contact us directly to discuss your concerns and attempt informal resolution
  • Provide us with a reasonable opportunity to address and resolve the issue
  • Consider mediation as an alternative dispute resolution method before litigation

Most disputes can be resolved through direct communication and good faith negotiation.

14. Class Action Waiver

To the extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action or class-wide arbitration.

15. Severability

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed. The remaining provisions shall continue in full force and effect.

16. Entire Agreement and Amendments

These Terms and Conditions, together with our Terms of Service, Privacy Policy, and any written service agreements, constitute the entire agreement between you and Oikos Care regarding the subject matter herein and supersede all prior or contemporaneous communications and proposals.

No amendment to these terms shall be binding unless made in writing and signed by an authorized representative of Oikos Care.

17. Waiver of Rights

No waiver of any term, provision, or condition of these Terms and Conditions shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision.

18. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, labor disputes, government actions, epidemics, or pandemics. In such cases, our obligations will be suspended for the duration of the force majeure event.

19. Survival of Terms

Provisions of these Terms and Conditions that by their nature should survive termination shall survive, including but not limited to provisions regarding liability limitations, indemnification, dispute resolution, and intellectual property rights.

20. Assignment and Transfer

You may not assign, transfer, or delegate any of your rights or obligations under these terms without our prior written consent. We may freely assign or transfer our rights and obligations under these terms without restriction. Any attempted assignment in violation of this provision shall be void.

Oikos Care maintains appropriate liability insurance coverage for our business operations. However, clients are strongly advised to maintain their own property and contents insurance. We recommend:

We reserve the right to modify, update, or replace these Terms and Conditions at any time at our sole discretion. Material changes will be communicated by updating the "Last updated" date at the top of this page and, where appropriate, through email or website notifications.

Your continued use of our services following the posting of changes constitutes your acceptance of those changes. It is your responsibility to review these terms periodically. If you do not agree to any modifications, you must discontinue use of our services.
